Who you are buying from

This website is operated by Whodavila, trading as Fig & Fox, Meadow Place Road. Contact: whodavila1@gmail.com. By placing an order you agree to these terms.

Eligibility

You must be at least 18 and able to enter into a legally binding contract to buy from us.

How a contract is formed

Your order is an offer to buy. Our order confirmation email is an acknowledgement, not an acceptance. A contract is formed when we email you to confirm your order has been dispatched. If we cannot supply an item, or if it was listed at an obviously incorrect price, we may decline your order and will refund you in full.

Prices and payment

Prices are in pounds sterling and include VAT where applicable. Delivery is charged separately at the rates shown in our shipping policy. Payment is taken at the point of order.

Discount codes

Discount codes may be limited to one use per customer, may exclude sale items, and may be withdrawn at any time. Only one code can be used per order unless we say otherwise.

Product descriptions and images

We describe our products as accurately as we can. Colours can vary between screens, and packaging may change. Sizing for baby and toddler clothing is a guide, not a guarantee of fit.

Safety, and how our products should be used

Our products are intended for use by babies and toddlers under the direct supervision of a responsible adult. Please read and keep any instructions supplied with an item, and follow the age and weight guidance shown.

Some of our products are comfort or convenience items rather than safety equipment. Where a listing says an item is not a lifejacket, not a helmet, or otherwise not protective equipment, that statement is part of the product description and must not be read as understatement. No product we sell removes the need for adult supervision, and none should be relied on to prevent injury or drowning.

If you have any doubt about whether a product is suitable for your child, please ask us before you buy.

Our liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, for defective products under the Consumer Protection Act 1987, or for anything else that cannot lawfully be limited. Your statutory rights as a consumer are not affected by anything in these terms.

Subject to that, we are responsible for loss you suffer that is a foreseeable result of us breaking these terms, and we are not responsible for losses that were not foreseeable.

Things outside our control

We are not liable for delays caused by events beyond our reasonable control, such as carrier disruption, extreme weather or supplier failure. We will let you know if such an event occurs and you may cancel and receive a full refund if the delay is substantial.

The content of this site, including text, images and our brand, belongs to us or is used with permission, and may not be reproduced commercially without our consent.

Governing law

These terms are governed by the law of the United Kingdom. If you live elsewhere in the United Kingdom, you may bring proceedings in the courts of the country where you live.

Changes

We may amend these terms. The version in force is the one published on this site when you place your order.
